Terms & Conditions
Straightforward rules for the website and the conversations that start here.
01. About these terms
These Terms and Conditions govern use of the Your Web Creators (“YWC”) website. By using the website, you agree to these website terms to the extent permitted by applicable law. Purchasing services requires a separately accepted written proposal, statement of work, or services agreement. Browsing, preparing an inquiry, or booking a conversation does not itself purchase services. Questions may be sent to hello@yourwebcreators.com.
02. Proposals and order of precedence
A written services agreement identifies the parties, scope, price, schedule, deliverables, review process, responsibilities, and any project-specific terms. If that agreement conflicts with general information on this website, the signed agreement controls for the engagement. Changes in scope, delivery dates, or price must be approved in writing by both parties before the additional work is undertaken.
03. Published prices and excluded costs
Website prices are starting estimates in US dollars for the stated scopes, not binding offers for every project. Applicable taxes, advertising spend, domain registration and renewal, platform fees, payment processing charges, premium licenses, and other identified third-party costs are excluded unless a proposal expressly includes them. We will disclose applicable costs and assumptions before acceptance. An inquiry does not reserve a schedule or fix a price.
04. One-Time Payment and Monthly Rental
One-Time Payment means the agreed base amount is paid upfront under the proposal. Monthly Rental means a fixed 12-month payment plan whose total is 25% higher than that base amount; each payment equals the base amount multiplied by 1.25 and divided by 12. It is not an unlimited or cancel-anytime subscription. Marketing, SEO, PPC, and hosting pricing covers a defined 12-month service term, while the other listed starting prices cover one specified project. Renewal is not automatic unless a separately accepted agreement expressly says otherwise.
05. Payment, delays, and suspension
Invoice due dates and any deposits are stated in the services agreement. If an undisputed payment is overdue, we may pause affected work after reasonable written notice and an opportunity to resolve the issue, subject to applicable law and the agreement. Delayed approvals, missing assets, or changed requirements can affect delivery dates. We will communicate a revised schedule rather than silently treating the original date as achievable.
06. Client responsibilities and approvals
You are responsible for the accuracy and legality of materials, instructions, business claims, and information you provide, and for obtaining necessary rights and permissions. Provide timely access, consolidated feedback, and approvals through the agreed decision-maker. Approval of a direction authorizes work within that approved direction; new directions or additional review rounds may require a change order. We will identify the requested additional scope before charging for it.
07. Ownership and licenses
Unless the signed agreement says otherwise, transferable rights in approved, original, paid-for final deliverables pass to the client after full payment. Under Monthly Rental, the client receives a license to use approved deliverables during the agreed term, with transferable rights passing after all scheduled payments are made. Unselected concepts, general know-how, reusable methods, and pre-existing agency materials remain with their owner. Third-party fonts, stock media, software, code libraries, and platform services retain their own license terms. Domain names and business platform accounts should be registered to the client. Source files are included only as stated in scope.
08. Confidentiality and portfolio use
Each party should protect non-public information received in connection with the engagement and use it only for the agreed purpose, except where disclosure is required by law or the information is already lawfully public. Portfolio publication, testimonials, and disclosure of non-public results require appropriate permission. Concept studies displayed on this website are identified as independent explorations and are not represented as commissioned client work. Illustrative review content is not evidence of an actual customer relationship.
09. Third-party platforms and results
Third-party platforms control their pricing, availability, policies, approvals, and algorithms. We cannot guarantee platform acceptance, uninterrupted third-party services, search rankings, a volume of leads, sales, or advertising returns. Estimates and strategic recommendations are not guarantees. We remain responsible for performing our agreed services with the care required by the applicable agreement and law.
10. Cancellation, refunds, and closeout
The services agreement sets cancellation and closeout procedures. Charges for completed work, approved non-cancelable commitments, and any lawfully agreed plan obligations may remain payable. Any refundable unused amount is reconciled against those obligations. Monthly Rental has a 12-month commitment; an early exit requires a written closeout arrangement and is not automatically a cancellation of remaining obligations. Nothing here removes refund, cancellation, or other consumer rights that applicable law makes mandatory.
11. Support and acceptance
Included review rounds, acceptance criteria, testing responsibilities, and post-launch support are defined in the proposal. The listed website and app starting scopes include a 30-day defect correction window for issues within the agreed delivered scope. New features, content changes, third-party platform changes, and problems caused by later modifications are separate work unless agreed otherwise. Security and accessibility requirements for a particular regulated use must be explicitly scoped; no general marketing statement replaces a required specialist assessment.
12. Acceptable website use
Do not misuse the website, attempt unauthorized access, interfere with its availability, submit unlawful content, or infringe another person’s rights. You may link to public pages and share short references with appropriate attribution. You may not copy the website’s original design, branding, or content for commercial reuse without permission, except as allowed by law. Third-party assets remain subject to their respective licenses.
13. Website availability and liability
The website is provided on an “as available” basis, and we may correct errors or change its content. To the extent permitted by law, we disclaim implied warranties for use of the website and are not liable for indirect or consequential losses caused solely by website use. Liability for paid services is governed by the signed agreement. Nothing in these terms excludes liability for fraud, willful misconduct, gross negligence where exclusion is prohibited, death or personal injury where protected by law, or any liability or remedy that cannot lawfully be excluded or limited.
14. Disputes and applicable law
Please first contact us to discuss a concern and allow a reasonable opportunity for a practical resolution. The governing law and forum for paid services are specified in the signed agreement. If none is specified for a website dispute, applicable conflict-of-laws rules determine the governing law and competent court. These terms do not impose mandatory arbitration, waive class-action rights, or restrict non-waivable rights provided by the laws that apply to you.
15. Changes, severability, and contact
We may revise these website terms prospectively by publishing an updated effective date. Changes do not retroactively amend an existing signed services agreement without consent. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A delay in enforcing a right is not a waiver of that right.
